FOREIGN MINORS IN ITALY
A minor of 18 years of age who is a foreigner and is in Italy is entitled to all the rights guaranteed by the New York Convention on the Rights of the Childwhich states, among its principles, that in all decisions concerning the child, the 'best interests' of the child must be a primary consideration.
The minor may be:
- accompanied, if he/she is entrusted with a formal measure to a relative within the third degree legally residing in Italy;
- unaccompanied, if he/she is without parents or other adults legally responsible for his/her care and representation.
RIGHTS GRANTED TO FOREIGN MINORS
Right to Education:
All foreign minors, even those without a residence permit, have the right to be enrolled in school, not only in compulsory education, but at all levels;
Right to Health Care:
Foreign minors holding a residence permit must be compulsorily enrolled in the National Health Service (SSN) by the person exercising parental authority or guardianship over them, with the consequent right to access all the healthcare services offered.
Foreign minors without a residence permit cannot register with the SSN, but they have the right to essential outpatient and hospital care, urgent and continuous care, illness and accident and preventive medicine. They are also guaranteed services such as vaccinations, international prophylaxis, diagnosis, prophylaxis and treatment of infectious diseases.
FAMILY MEMBER WITHOUT RESIDENCE PERMIT OF A FOREIGN CHILD
Pursuant to Article 31, paragraph 3, of Legislative Decree no. 286/98 (Consolidated Act on Immigration), the Juvenile Court, for serious reasons related to psychophysical development and taking into account the age and health conditions of the minor who is in the Italian territory, may authorize the stay of the family member, for a fixed period of time.
